Bluestairs may monitor use of the Services to ensure compliance.
4. Messaging Services (SMS/Email)
Bluestairs provides tools that allow you to send SMS and other electronic communications to end users. By using these features, you agree to:
Obtain and document express consent from recipients before sending messages.
Comply with all applicable laws and carrier rules (including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and 10DLC A2P messaging regulations).
Provide clear opt-out instructions in each message (e.g., “Reply STOP to unsubscribe, HELP for help”).
Not use the Services to send spam, fraud, or illegal content.
End User Acknowledgment: By opting in, end users consent to receive SMS messages from Bluestairs. Message frequency may vary. Standard message and data rates may apply. Users may opt out at any time by replying STOP and may obtain assistance by replying HELP.
5. Intellectual Property
All content, features, and functionality of the Services are owned by Bluestairs and are protected by intellectual property laws.
You may not copy, modify, or distribute our content without prior written consent.
6. Third-Party Services
The Services may integrate with third-party platforms (e.g., Twilio). Your use of those services is subject to the terms and policies of the respective providers. Bluestairs is not responsible for third-party services.
7. Termination
Bluestairs may suspend or terminate your account and access to the Services at any time, with or without cause, and without notice. Upon termination, your right to use the Services will immediately cease.
8. Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE.” Bluestairs makes no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Bluestairs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability to you for any claim shall not exceed the amount you paid Bluestairs in the past twelve (12) months.
10. Indemnification
You agree to indemnify and hold harmless Bluestairs, its affiliates, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Services or violation of these Terms.
11. Governing Law
These Terms are governed by and construed under the laws of the State of California, without regard to conflict of laws principles.

Bluestairs may update these Terms at any time by posting a revised version on our website. Your continued use of the Services after changes take effect constitutes your acceptance of the new Terms.
